AfghanEvac Terms of Use

Please read these Terms of Use carefully. They govern your use of afghanevac.org, the V-PRIC tool at pathways.afghanevac.org, and our other online services that link to these terms (together, our "Services"). By using our Services, you agree to these terms. If you do not agree, please do not use the Services.

Who we are

AfghanEvac is a 501(c)(3) charitable organization (EIN 87-3921693) that leads and manages a coalition of private, nonprofit, governmental, and volunteer organizations working to help Afghans relocate and resettle safely, lawfully, and swiftly. We coordinate communication and effort across that coalition and provide certain resources for the benefit of the public and of coalition members.

We do not directly provide immigration, legal, evacuation, or relocation services to individuals, and we assume no liability for the services or data provided by coalition members or other third parties.

What our Services are, and are not

Our Services are educational and informational. They are designed to help you understand immigration and relocation pathways and to find further resources. They are a starting point for research, not a source of decisions.

Not legal advice. Nothing in our Services, including the V-PRIC tool and any answer it generates, is legal advice. Immigration law is complex, fact-specific, and subject to change without notice. Information that was accurate when published may no longer be accurate when you read it.

No attorney-client relationship. Using our Services does not create an attorney-client relationship between you and AfghanEvac or anyone acting on our behalf. For advice about your specific situation, consult a qualified immigration attorney or an accredited representative. To find a qualified attorney, you can visit ailalawyer.com.

Artificial intelligence. The V-PRIC Find My Pathway assistant uses artificial intelligence to generate responses. AI can produce information that is incomplete, outdated, or wrong. Always verify anything you learn through our Services directly with the relevant government authority or a qualified professional before acting on it.

No government affiliation and no guarantee of outcomes. AfghanEvac is not the U.S. government and does not speak for it. We cannot grant, expedite, or guarantee any immigration benefit, visa, status, or relocation outcome, and nothing in our Services should be understood as a promise of any result.

Not for emergencies. Our Services are not an emergency service and are not a secure channel for sensitive personal information. If you are in immediate danger, contact UNHCR at unhcr.org or your nearest embassy.

Acceptable use

When you use our Services, you agree that you will not enter another person's personal information without their knowledge and consent, will not rely on the Services in an emergency, will not use the Services for any unlawful purpose, will not attempt to disrupt, damage, scrape, overload, or gain unauthorized access to the Services or their underlying systems, and will not misrepresent the Services or use them to mislead others. We ask that you not enter sensitive identifiers such as full names, addresses, phone numbers, or immigration case numbers into the tools.

Intellectual property

The content we create for our Services, including text, graphics, logos, and the V-PRIC tool, is owned by AfghanEvac or its licensors and is protected by law. We want accurate information to reach the people who need it, so you may share and reference our educational content with attribution and without alteration, but you may not sell it, present it as your own, or use our name or logos to imply endorsement without our permission. Some content is provided by third parties and remains theirs.

Third-party links and resources

Our Services link to websites, tools, and resources operated by others, including government agencies and coalition members. We provide these for convenience and do not control or endorse them, and we are not responsible for their content, accuracy, or practices. Your use of any third-party service is governed by that party's own terms.

Donations

Donations made through our Services are processed by a third-party payment processor and are subject to that processor's terms. AfghanEvac is a 501(c)(3) organization, and contributions are tax-deductible as permitted by law.

Disclaimers

OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT ANY INFORMATION THEY PROVIDE IS CURRENT, COMPLETE, OR ACCURATE. YOU USE THE SERVICES, AND RELY ON ANY INFORMATION THEY PROVIDE, AT YOUR OWN RISK.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, AFGHANEVAC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICES OR ANY INFORMATION THEY PROVIDE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 

Indemnification

You agree to indemnify and hold harmless AfghanEvac and its officers, directors, employees, volunteers, and agents from any claims, losses, liabilities, and expenses, including reasonable attorneys' fees, arising out of your misuse of the Services or your violation of these terms.

Changes to the Services and these terms

We may change, suspend, or discontinue any part of the Services at any time. We may also update these terms from time to time. When we make material changes, we will update the date above and, where appropriate, provide additional notice. Your continued use of the Services after an update means you accept the revised terms.

Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we handle information. Please review it at afghanevac.org/privacy-policy.

Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these terms or the Services will be resolved in the state or federal courts located in San Diego County, and you consent to their jurisdiction.
