I’m writing to urge you to take immediate action to stop a draft Department of Homeland Security policy that would make it harder for immigrants from countries covered by the President’s travel ban, including Afghanistan, to obtain green cards and other lawful status.

According to reporting by The New York Times (November 14, 2025), the proposal would direct U.S. Citizenship and Immigration Services (USCIS) officers to treat “country-specific factors” as “significant negative factors” when reviewing applications for green cards, asylum adjustments, parole renewals, and other immigration benefits.

In practice, this would mean Afghans could be denied immigration benefits solely because of their nationality, even if they’ve already been vetted, admitted legally, and built their lives here in the United States. Refugees, parolees, and Special Immigrant Visa holders who trusted America’s promises could face denials or indefinite limbo.

This policy has not yet gone into effect, and there is still time to stop it. But if finalized, it would:

  • Treat being born in Afghanistan as a “negative factor” in immigration decisions.

  • Apply inside the United States, reaching people who have already passed security vetting.

  • Undermine America’s moral and legal commitments to our wartime allies.

  • Create a chilling precedent that nationality alone can determine one’s worthiness to stay in this country.

I respectfully urge you to:

  1. Publicly call on DHS to withdraw this proposal before it is finalized.

  2. Demand oversight hearings in the House and Senate Judiciary Committees and the Foreign Affairs/Foreign Relations Committees to examine its impacts.

  3. Codify protections for Afghan wartime allies, refugees, and humanitarian parolees to ensure nationality cannot be used as a “negative factor” in discretionary decisions.

  4. Support and advance legislation such as the Afghan Adjustment Act and the Enduring Welcome Act, which offer clear, secure pathways to lawful permanent residence for Afghans who served alongside us.

This is a moral issue as much as a policy one. America made a promise to the people who stood with us and our credibility depends on keeping it.
